Online Gambling Laws in the United Kingdom

Online gambling is legal in the UK. It is regulated by the United Kingdom Gambling Commission (UKGC), which oversees all forms of gambling, including online casinos, sports betting, and lotteries. The Commission was established under the 2005 Gambling Act that legalized internet gaming in the region. It replaced the Gaming Board in 2007 when it became fully functional and began regulating the National Lottery in 2013. All online gaming operators must hold a valid license from the Commission to operate in the UK.

The UKGC holds gambling companies to rigid standards to ensure they conduct their activities fairly. It enforces rules to protect children and vulnerable people from harm and keeps online gaming free of criminal activities. The Commission also implements strict regulations regarding gambling advertisement and requires its licensees to provide responsible gaming tools, including self-exclusion, deposit limits, and problem gambling support. Additionally, it advises the government on gambling-related matters and collaborates with the police over cases of suspected illegal gaming.

Online Gambling Laws in the United States

In 1961, President John F. Kennedy signed the Federal Wire Act into law, making it illegal for individuals to pass gambling information across state lines using electronic wires. This Act effectively prohibited all forms of online gambling, including casino gambling and sports betting, until 2011, when the states of New York and Illinois petitioned the Department of Justice regarding the issue. These states intended to start selling online lottery tickets and wanted to know if the Wire Act covered only sports betting or all types of online gambling.

The DOJ responded with a memorandum stating that the Act only applies to sports betting, opening the door to the legalization of most forms of online gambling. This reinterpretation empowered US states to enact online gaming laws and decide which games are legal within their territories. States where online casino games are permitted include Connecticut, Delaware, Michigan, Nevada, New Jersey, Pennsylvania, and West Virginia. Online casinos must possess licenses from the appropriate state authorities to offer their services to residents.

Online Gambling Laws in Canada

Online gambling laws in Canada are somewhat ambiguous. The country's Federal Criminal Code prohibits all forms of gaming. However, Section 207 of the Code exempts provincial governments and permits them to conduct and regulate gambling activities within their province. Online casinos are also prohibited from operating within Canada's territories, so Canadians often resort to offshore sites. Note that gambling on offshore sites is a risky affair, as many of those platforms are unregulated. Generally, online gaming is legal in Canada, provided you gamble on an overseas site or a platform backed by your provincial government.

In 2022, Ontario became the first Canadian province to launch a legal, regulated internet gambling market. Casino operators must obtain a license from the Alcohol and Gaming Commission of Ontario (AGCO) and enter into an operating agreement with iGaming Ontario (iGO) to legally offer their services within the province. Other provinces that allow online gambling include Manitoba, British Columbia, Alberta, Saskatchewan, etc.
